That lawsuit was filed by the National Center for Transgender Equality and was filed in July of 2013 with the U.S. federal court in Kansas City and brought by the ACLU of Kansas in Washington. The lawsuit asks that the transgender plaintiffs, who have faced discrimination in their lives as both male and female, be able to sue the United States government in the Federal Circuit Court of Appeals to determine whether they can sue the government for discrimination based on their gender identity.
The suit challenges to the Government's definition of "sex-questionable" in Kansas and the court's treatment of transgender identity. The plaintiffs in the suit contend government employees have no standing to sue for gender identity discrimination because their hiring practices discriminate not on the basis that their sex is gender specific.
